Attorney Rosenberg's trial experience includes successfully representing numerous clients in both jury and non-jury trials in a variety of contract matters, divorce and custody cases, personal injury actions, real estate litigation, employment disputes and securities fraud claims. Mr. Rosenberg has also represented a number of small and medium sized businesses before the Massachusetts Commission Against Discrimination and in various Courts on a variety of business disputes and sexual harassment cases. Mr. Rosenberg's current practice areas include divorce and probate matters, securities litigation and business litigation. A sampling of Mr. Rosenberg's clients past and present includes Capeway Sunoco, Rosie's Pastries, Inc., Venture Tape Corporation, Boston Water and Sewer Commission, Sturbridge Isle Corp., and Peter Fuller Oldsmobile, Inc. Some of Mr. Rosenberg's matters have included: Patsos v. First Albany Corporation, 433 Mass. 323, 741 NE2d 841 (2001), further appeal from 48 Mass.App.Ct. 266, 719 NE2d 882 (1999). In this reported case the Supreme Judicial Court ruled in favor of Mr. Rosenberg's client that a fiduciary relationship existed between Mr. Patsos and the brokerage firm of First Albany Corporation. This first impression case held that a fiduciary relationship as opposed to a pure business relationship could exist between a broker and a client. Goldberg, et al. v. Wolf, et al. The Court held that the majority shareholder of a thinly capitalized corporation could not be held liable for the debt of the corporation even though the corporation commingled funds with personal assets, where without evidence of fraud, their was no piercing of the corporate veil. Jane Doe v. John Doe. A medical malpractice action, which resulted in a settlement for Jane Doe of in excess of $800,000.00. The details of the action and terms of the settlement remain confidential. Zoppo v. Foster, 1997 WL197025 (Mass.Super). A successful defense of a Anti-SLAPP claim in which the plaintiff alleged defamation and slander, and defendant brought a Special Motion to Dismiss the plaintiff's claims on the basis that defendant's video-taped statements at a Board of Selectmen's meeting that the plaintiff was an "environmental criminal" were protected as petitioning activities. Mr. Rosenberg is a founding partner of Kurnos Rosenberg & Libbey LLP. He graduated with Honors from the University of Delaware in 1989 and New England School of Law in 1983.
